All cases under the Vested Property Act will proceed in the Tribunal

Dhaka, June 8: The High Court dismissed the writ challenging the validity of three sections (9, 13 and 14) of the Vested Property Act. As a result, all cases of this law will be tried in a special tribunal from now on. No other court will proceed with this case.

A three-member High Court bench headed by Justice Naima Haider passed the verdict on Thursday (June 8). The other two are Justice Sahidul Karim and Justice SM Quddus Zaman. Advocate Kamrul Haque Siddiqui and Barrister Omar Farooq were in favor of the writ in the court that day. Senior lawyer Advocate Manzil Morsed appeared for the Ministry of Lands. Deputy Attorney General Amit Dasgupta appeared for the state.

Manzil Morsed, the senior lawyer of the Supreme Court, said that as a result of this judgment, all cases related to assigned property will be tried in the special tribunal related to assigned property. No other court will proceed with this case. All cases pending in other courts regarding the vested property will be dismissed. If anyone has any objection to the assigned property, they have to go to a special tribunal.

In the judgement, the court said that Sections 9, 13 and 14 of the Vested Property Act are not violative of fundamental rights. The vested property will be under the jurisdiction of the Deputy Commissioner and the Deputy Commissioner may grant lease if necessary. Earlier two separate writs were filed challenging three Sections 9, 13 and 14 of the Transfer of Property Act, 2001. After hearing that writ, the larger bench of the High Court dismissed the ruling.
