Japanese children custody: Case to continue in district court

Dhaka, June 12: The High Court rejected the appeal of Imran Sharif, the father of the children, seeking a change of court for hearing the appeal regarding the custody of the two Japanese children, Jasmine Malika and Laila Lina. The court said that according to the instructions of the Appellate Division, this appeal case will be disposed of by the District Judge Court. A single High Court bench of Justice Mamnoon Rahman passed the order on Monday.

Advocate Nasima Akhter Lovely heard on behalf of Imran Sharif in the court. Barrister Ajmalul Hossain KC, Advocate Ahsanul Karim and Advocate Mohammad Shishir Monir heard on behalf of Nakano Erico. Earlier on June 1, the High Court dropped the application of Imran Sharif, the father of the children, from the list of proceedings seeking to change the court of appeal regarding the custody of the two Japanese children Jasmine Malika and Laila Lina. Later, this application was presented to the new bench by the lawyer of the children's father, Advocate Muhammad Shishir Monir.

Later, lawyer Shishir Monir said, the Appellate Division ordered the District Judge of Dhaka to settle the appeal within three months regarding the custody of the two Japanese children, Jasmine Malika and Laila Lina. This appeal is scheduled for hearing in the District Court of Dhaka. But the children's father, Imran Sharif, applied for a hearing in the High Court instead of hearing it in the court of the Appellate District Judge. The High Court dismissed the petition.

On March 9, the Appellate Division rejected the appeal of a Japanese mother to take two Japanese children, Jasmine Malika and Laila Lina, abroad. At the same time, the court ordered the appeal district judge court to settle the matter within three months regarding who will have custody of the two children. Till this time the two children Jasmine Malika and Laila Lina will remain as they are.

A seven-judge appellate bench headed by Chief Justice Hasan Faiz Siddiqui passed the order.
