Japanese mother will stay with her children, father allowed to visit during the day: Court

Dhaka, October 1: Japanese mother Nakano Erico will stay with her two children, Jasmine Malika and Laila Lina, in a flat in Dhaka;s Gulshan neighbourhood. Bangladeshi father Imran Sharif will be able to meet his children only during the day. The rent of the flat should be borne equally by the parents of the children. The order will remain in force till October 21. The High Court will give the next order on that day.

A virtual bench of the High Court comprising Justice M Enayetur Rahim and Justice Md Mostafizur Rahman on Thursday (September 30) passed the order after hearing the case of Japanese mother Nakano Erico with two children and Bangladeshi-American Baba Sharif Imran and their two daughters.

Advocate Mohammad Shishir Monir was in favor of the Japanese mother in court on Thursday. Senior lawyers Fida M Kamal, Fawzia Karim Firoz and Md. Mostafizur Rahman were on the father's side.

Earlier, the father and mother were staying with their two children in a rented flat in Gulshan from September 16 under the direction of the High Court. On the same day, the court said it was good for the children and asked the lawyers of both the parties to find a beautiful solution to protect the image of the country.

On August 23, their father Imran Sharif proposed to keep the two children at the Victim Support Center of Dhaka Metropolitan Police with their mother in a better home. On August 31, the court ordered the parents to stay in a rented house in Gulshan for 15 days with the permission of their lawyers.

Nakano Erico, a Japanese doctor, came to Dhaka on August 19 and filed a writ petition seeking directions to bring the children back to the High Court to get their two daughters back. On the same day of the preliminary hearing of the writ petition, the same bench of the High Court directed their father Sharif Imran and uncle to produce the two children in court on August 31.

The court directed the Officer-in-Charge (OC) of Gulshan and Adabar police stations to ensure the presence of the children in the court. At the same time, a 30-day ban was imposed on August 19 to prevent their father from leaving the country with their two children.

Then on September 6, Nakano Erico, a Japanese citizen, was allowed to move around with his two daughters in an open environment and sleep with them at night. The High Court ruled that the father could stay with the two children during the day.
