Dhaka, November 15: Election Commissioner (EC) Md Alamgir said there is no legal obstacle to Md Sahabuddin's assumption of office as president.

He said, "Since the President is a non-profitable post, there is no legal obstacle for Md Sahabuddin to take charge as the 22nd President."

On Tuesday (February 14), he told reporters in his room at the election building in Agargaon.

By law, ACC commissioners cannot hold any position of profit. A question has also arisen about whether the presidency is profitable or not. What is the interpretation of the EC? EC Md Alamgir said in response to such a question, "The ACC Act says that commissioners cannot hold positions of profit. But when the Election Commission did it, it took a decision knowing the law. When Justice Shahabuddin Ahmed assumed the post of President, there was a case in the court about it. It happened. Because the same law applies to judges that they can't go into lucrative positions."

He said, "Since there was a case at that time and the High Court gave a judgment in that case. It said, there is no bar and no appeal against that order. Since we have a concrete example of the High Court before us, the office of President can be called a lucrative office." No. It is said in that judgment, "profitable post" means those who are officers and employees of the republic. It is clearly stated. It does not apply to him (Md. Sahabuddin). There is no legal obstacle for him to sit in the office of the President."

Md Alamgir said, "One thing must be understood, it is very clear about the position of profit, what is meant by the position of profit, although the list is not given. But in the case of position of profit, it is said that if the government is engaged in the work of the republic and in any institution, the government has more than 50 percent of the money. , then the appointment to that position will be called a profitable position. Here, the president or the prime minister or the ministers are not any officials engaged in the work of the republic. These are constitutional positions. Since constitutional positions do not fall under the definition of profitable positions."
