Dhaka, May 9: The High Court has dismissed the petition challenging the legality of framing of charges against former Superintendent of Police (SP) Babul Akhter in the case of the murder of his wife Mahmuda Khanom (Mitu). As a result, there is no hindrance in the case of wife murder against Babul Akhter in the judicial court, said the lawyer of the state.

A High Court bench headed by Justice SM Quddus Zaman passed the order on Tuesday. Deputy Attorney General Sujit Chatterjee Bappi heard for the state in the court. Advocate Muhammad Shishir Monir appeared for the accused.

Earlier, on March 23, the court framed charges against seven people including former Superintendent of Police (SP) Babul Akhtar in the Mahmuda Khanam (Mitu) murder case. The Third Additional Metropolitan Sessions Judge Court of Chittagong gave this order.

Along with Babul Akhter, the other six accused in the charge sheet are - Md. Kamrul Islam Shikder alias Musa, Ehteshamul Haque alias Bhola, Md. Motaleb Mia alias Wasim, Md. Anwar Hossain, Md. Khairul Islam alias Kalu and Shahjahan Mia. Among them, Babul, Wasim, Shahjahan and Anwar are in jail. On bail, Kamrul Shikder Musa and Khairul Islam Kalu are absconding from the start.

Later, Babul Akhtar appealed to the High Court challenging the validity of the complaint. On June 5, 2016, Babul Akhtar's wife Mahmuda Khanam was hacked and shot dead on her way to drop off her son in the school bus in GEC area of Chittagong city. The next day (June 6), Babul first filed a murder case at the city's Panchlaish police station as a plaintiff.
