Prior permission should be taken for the arrest of government employees

Dhaka, 5 July 2023 : In criminal cases filed against employees of self-governing bodies, state-owned institutions and local government institutions in connection with performance of duties, prior permission of the government or the appointing authority should be obtained before the court accepts the charge sheet.

Keeping such a provision, the 'Government Employment (Amendment) Bill-2023' was passed in the National Parliament on Tuesday (July 4).

In this, the salaries and allowances, retirement benefits of employees employed in self-governing organizations, state-owned organizations and local government organizations have been brought under the Public Service Act.

Jatiya Party Member of Parliament Pir Fazlur Rahman said that this law will conflict with the law of autonomous institutions. He said, in a criminal case, anyone is arrested before a charge is filed. No one's permission is required for this.

But government servants cannot be arrested before receiving complaints. It is against the principle that everyone is equal in the eyes of the law.

Member of Parliament of Gano Forum Modabbir Khan said, "There is extreme chaos in public administration today. They do not respect warrant of precedence. Some employees of the Republic consider themselves self-proclaimed Marshal Ayub Khan or his followers. They took a stand against the people and public representatives by taking decisions that were independent and in conflict with the public interest.

Independent Member of Parliament Rezaul Karim demanded to increase the age limit for entering government service to 35 years. He said, in the developed countries of the world, the age limit for employment has been fixed up to 59 years. But in Bangladesh it is at a very low level. If the age limit is made to 35 years, the problem of unemployment will be reduced.

State Minister for Public Administration Farhad Hossain raised the bill for passage in the National Parliament. After sending the public opinion on the bill to the committee and settling the amendment proposals, the bill was passed by voice vote.

The Government Employment (Amendment) Bill, 2023 states that the provisions of Sections 15, 41, 42, 43, 44 and 45 of the Government Employment Act, 2018 shall apply to employees employed in autonomous bodies, state-owned enterprises and local government institutions.
