Japanese children custody: Younger daughter to stay with father, first born with mother

Dhaka, March 10: The Supreme Court has directed the District Judge Court of Dhaka to dispose of the appeal filed by their father Imran Sharif of Bangladeshi origin within three months regarding the custody of two children from Japan. At the same time, both sides have been asked to maintain the status quo.

As a result of the Appellate Court's order of status quo in the dispute between a Bengali father and a Japanese mother over two children, the elder daughter, who is with the mother, will remain with her mother, while the younger daughter will stay with the father. At the same time, the order said, the Japanese mother cannot go abroad with her two children.

In this regard, Imran Sharif's lawyer said, "The children's mother tried to leave with the children twice by disobeying the order of the Appellate Division. The lawyer of the children's mother, Erico, has expressed regret to the Appellate Division. The Appellate Division has warned Erico about this for the future."

During the hearing, the court said, "Not all solutions can be provided in the court. If both parties (father and mother of the children) are desperate, we have a problem."

On Thursday (March 9), the seven-member Appellate Division headed by Chief Justice Hasan Faiz Siddiqui gave this order with observation. Lawyers Azmalul Hossain QC, Ahsanul Karim and Mohammad Shishir Monir were present in the court on Thursday on behalf of the children's mother. Lawyers Akhtar Imam, Rashna Imam and Mushtaq Ahmed appeared for the father.

According to lawyers, Eriko Nakano filed a separate appeal to the Appellate Division seeking a partial review of the order issued by the Appellate Division on February 13 last year not to take the two children from Japan out of the country without the court's permission and accusing the children's father of contempt of court. And children's father Imran filed an appeal in the Appellate Division against the children's mother for contempt of court.

On July 11, 2008, Nakano Eriko and Sharif Imran got married according to Japanese law. After marriage they started living in Tokyo. Three daughters were born to them in 12 years of marriage. Two of them are now in Bangladesh and the other in Japan with their grandmother.
