Japanese mother's appeal against father of two children rejected

Dhaka, June 2: The Appellate Division has rejected the contempt of court petition filed by Japanese mother Nakano Erico against two children Jasmine Malika and Laila Lena's Bangladeshi father Imran Sharif. At the same time, the court also rejected the contempt of court petition filed by Imran Sharif against Nakano Erico.

The Appellate Division headed by Chief Justice Hasan Fayez Siddiqui passed the order on Thursday (June 2nd). Senior lawyer Barrister Ajmalul Hossain QC appeared for Nakano Erico in the court. He was assisted by Advocate Mohammad Shishir Monir. Senior lawyers Barrister Akhtar Imam and Barrister Rashna Imam appeared for Imran Sharif.

Earlier, on May 16, their Japanese mother Nakano Erico filed a contempt of court petition against two Japanese children, Jasmine Malika and Laila Lena's Bangladeshi father Imran Sharif.

On that day, lawyer Shishir Monir said that the Appellate Division had instructed that the mother of the two children should stay in Baridhara with Nakano Erico. Parents will be able to meet the children. Disobeying this instruction, Imran Sharif forcibly went out with the children from time to time. That is why we have applied for contempt of court. Later, Imran Sharif also filed a contempt of court petition against Nakano Erico.

The Appellate Division ruled that two children, Jasmine Malika and Laila Lina, would remain with their Japanese mother, Nakano Erico, until the case was settled in the Dhaka Family Court on February 13. Besides, the judgment of the High Court in this regard was quashed. At this point Nakano Erico cannot leave the country with the children. The verdict said that father Imran Sharif will be able to meet the children.

A five-judge appellate bench headed by Chief Justice Hasan Fayez Siddiqui quashed the High Court's order. At the same time, the court asked the Second Additional Sessions Judge of Dhaka to settle the case regarding custody of two children within three months.
